The Firm represents clients in lawsuits involving copyright and trademark infringement and related injunctive relief. These lawsuits involve evidentiary hearings on the request for preliminary injunctive relief at the initiation of the lawsuit. As a result, these claims require immediate immersion into the facts and circumstances surrounding the claimed infringement and presentation of evidence showing that plaintiff lacks a substantial likelihood of success on the merits, lacks proof of irreparable injury, the defendant’s harm will outweigh plaintiffs or that the public would be harmed or disserved. This hearing often occurs within a month or months of the filing of a lawsuit and before discovery is completed. The result of the preliminary injunction hearing often dictates the outcome of the lawsuit and will in all likelihood hold serious consequences for one party. The Firm prepares for the preliminary injunction hearing by dedicating its resources to preparing for the preliminary injunction hearing.
