Maria Dalmanieras and Peter Restani from our Miami office tried a Wrongful Death hotel liability case in which decedent, a 44-year-old mother of four children and surviving spouse, requested medical treatment at the hotel which was summoned by the concierge to provide a house call physician. She was treated by the doctor at the hotel but died several days later on her birthday cruise with her family. Plaintiff alleged that the physician was an agent of the hotel and that the hotel was vicariously liable for his alleged medical malpractice causing her death. Plaintiff requested the jury to award $25 million and we received a net verdict totaling $12,500. The case was resolved post-verdict prior to appeal with no monies being paid by the clients to the Plaintiff.
