Todd Boyd, James K. Parker, and Marcus A. Nielsen obtained summary final judgment, in the U.S. District Court, Southern District of Florida, in favor of an Indiana attorney and law firm in a legal malpractice lawsuit where the plaintiff was claiming $8.9 million dollars in damages. The plaintiff alleged that the Indiana attorney was negligent by failing to properly draft trust documents that were found invalid by a Florida court. Our attorneys prevailed by showing the Court summary judgment was appropriate because the Indiana attorney properly drafted that trust documents in accordance with Indiana law since he reasonably determined the testator was domiciled in Indiana instead of Florida and that the plaintiff could not prove her case because of her failure to retain expert witnesses to opine on the standard of care.
